§ 1 

General information

  1. The Privacy Policy specifies how Users' personal data necessary for the provision of services electronically through the website: monikapoul.com are collected, processed and stored.
  2. The website collects only personal data necessary for the provision and development of the services offered therein.

Personal data collected through the Service is processed in accordance with the Regulation of the European Parliament and of the Council (EU) 2016/679 of April 27, 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data and the repeal of Directive 95/46/EC (General Data Protection Regulation, hereinafter referred to as RODO) and the Personal Data Protection Act of May 10, 2018.
  6. The customer has no statutory obligation to provide personal data, however, the obligation may arise from special regulations. The consequence of not providing personal data may be, in particular, the inability to provide services to the Customer, in particular the inability to conclude a contract for the sale of goods in the online Store.

 

§ 2 

Privacy protection

  1. By placing an Order, the Customer voluntarily consents to the processing of his personal data solely for the purpose of processing the Order.
  2. The customer has the right to inspect his/her data and correct them, as well as to demand their deletion.
  3. The Customer may also give separate, voluntary consent to receive advertising and promotional materials, newsletters.
  4. Provision of registration data by the Customer is necessary to carry out the purchase transaction. It is in the interest of the Customer to provide correct data to enable contact and delivery of Goods. The store is not responsible for the consequences resulting from incorrect data provided by the Customer.

§ 3 

Purpose of data processing

  1. The service uses personal data for the following purposes:
    • running the newsletter
    • operating the Order form
    • preparing, packing and shipping the Goods
    • execution of ordered services
    • presentation of an offer or transmission of information
    • contacting the customer for purposes related to the provision of services
  2. The Service performs functions of obtaining information about users and their behavior in the following ways:
    • by voluntarily entering data in the Order form, which are entered into the Operator's system.
    • by saving cookies (so-called "cookies") in the end devices.
  3. Enabling full use of the Store, including placing an Order.
  4. Providing customer service, including resolving technical problems
  5. Monitoring the activity of all and specific users including, but not limited to, keywords searched, Goods posted, and managing traffic to the Store.
  6. Ensuring the security of electronic services, including enforcing compliance with the Terms and Conditions and preventing fraud and abuse.
  7. Execution of sales agreements concluded in the Store, handling of customer complaints, possible mediation, judicial and statistical proceedings.

 

§ 4

Type and period of processing of personal data

  1. The Service for the implementation of the services of the contract processes the following data:
    • surname, first name, shipping address, e-mail address, contact telephone number, in the case of companies additionally the company name, its address and Tax Identification Number.
  2. Recipients of personal data may be/will be: courier/transport companies, companies providing IT support to the administrator, administrator's business partners, payment processing companies.
  3. Personal data shall be processed only for the period necessary for the performance of the contract or for the purpose for which consent was given. The data will be kept for a period of time that is adequate and no longer than the periods in accordance with the currently applicable laws in the respective areas of personal data processing.
  4. With regard to marketing data, data will not be processed for longer than 3 years.
  5. Data in sales documents are processed for the period required by accounting regulations.
  6. E-mail address used for contact and sending newsletters, advertising and information is processed for the period of validity of the Customer's consent. This consent can be revoked at any time.
  7. The Customer has the right to file a complaint against the actions of the Administrator to the President of the Office of Personal Data Protection in case of violation of the law on personal data processing.
  8. The Client has the right to: request access to personal data from the Administrator; rectify, delete or restrict processing of personal data; object to processing, data portability or withdraw consent at any time.

 

§ 5

Sharing of personal data

  1. The legal basis for the processing of personal data may be the consent given by the Customer (Article 6(1)(a) of the RODO), the need to take action at the Customer's request (Article 6(1)(b) of the RODO), or purposes related to a legitimate interest pursued by the Administrator or by a third party (Article 6(1)(f) of the RODO). The Administrator's legitimate interest is the need to offer customers the best possible quality of service, to tailor the offer of goods to the needs and expectations of buyers, as well as to conduct marketing, promotional and advertising activities, the recipients of personal data may be entities cooperating with the Administrator in the performance of tasks specified in point 9, in particular, companies providing services in the field of delivery of goods (couriers), banks, servicing the processes necessary for sending notifications about the implementation of orders, service providers providing advertising and marketing services, as well as companies cooperating with the Store, providing services in the field of invoicing, debt settlement and accounting.
  2. Customer's personal data may be transferred to third countries, i.e. outside the European Economic Area (EEA) or to international organizations, but only to entities that provide adequate safeguards and guarantee the rights of data subjects and effective legal protection measures. In particular, this includes the Administrator's use of services provided by Google and Facebook, to the extent that this is necessary for the purposes.

 

§ 6

Cookies

  1. The store uses information contained in cookies, but does not automatically collect any other information,
  2. Cookies (so-called "cookies") are IT data, in particular text files, which are stored on the website user's terminal equipment and are intended for use on the website. Cookies usually contain the name of the website they come from, the time they are stored on the device and a unique number.
  3. The entity placing cookies on the website user's terminal equipment and accessing them is the website operator. 
  4. Cookies are used for: authentication, including identification when placing an Order; verification and development of service and service offerings; providing personalized services to Customers; creating statistics for the Administrator's needs ( including as part of cooperation with external entities, for the purposes of Facebook's social networking site, where Facebook's privacy rules apply); using display advertising based on Google Analytics for remarketing services.
  5. The customer using the website agrees to the placement of cookies on his/her final device.
  6. Deletion of cookies by the Customer may result in the presentation of different store content, as well as in the loss of possibility to use some of the Shop's functions.
  7. Cookies placed on the Store User's terminal device may also be used by advertisers and partners cooperating with the Store operator.
  8. In many cases, web browsing software (Internet browser) allows the storage of cookies on the User's terminal device by default. Users of the Store can change their settings regarding cookies at any time. These settings can be changed, in particular, in such a way as to block the automatic handling of cookies in the settings of the web browser or inform about their placement on the Store User's device each time. Final provisions/regulations

  1. The Administrator has the right to make changes to the Privacy Policy, but the rights of Users will not be restricted.
  2. Information about the introduced changes will appear in the form of an announcement available on the Website.
  3. In matters not regulated in this Privacy Policy, the provisions of RODO and the provisions of Polish law shall apply.
