Terms and Conditions

§ 1 

General information

  1. Regulations define the rules for the provision of sales services through the website www.monikapoul.com
  2. The seller and at the same time the administrator of the online store is: Monika Poul, 80-313 Gdańske-mail: kontakt@monikapoul.com
  3. The Terms and Conditions are an integral part of the sales contract concluded with the Client and define the terms and conditions of sale of artistic works, hereinafter referred to as Goods.
  4. Through the Online Store, the Seller sells its products.
  5. The condition for the conclusion of a sales contract is the acceptance of the Regulations by the Customer.
  6. Goods available in the store are copyrighted, free from defects, both physical and legal. They are subject to legal protection and it is prohibited to copy them without the permission of the Seller.
  7. Prices given in the store are gross prices ( including taxes) and are expressed in Polish zloty (PLN). The prices do not include shipping costs.
  8. Information about the collection and protection of personal data can be found in the Privacy Policy.
  9. Sales are made via the Internet in the form of a contract concluded at a distance between the orderer called the Customer and the seller called the Store.
  10. Each Customer placing an order is obliged to become familiar with these Regulations. Unfamiliarity with the Regulations does not exempt from the application of the rules contained therein.
  11. In order to use the Online Store on the part of the Customer the following minimum technical requirements must be met: a device with Internet access, an installed web browser (Internet Explorer, Chrome, FireFox, Opera, Safari with JavaScript and Cookies enabled, an active e-mail account).
  12. The Customer is prohibited to provide unlawful content and use the Store in a manner that interferes with its operation or is burdensome to the Seller and other Customers. 
  13. Contracts are concluded in accordance with Polish law and in Polish language.

 

§ 2 

Definitions

  1. Online Store - the online service available at www.monikapoul/sklep.com, through which the Customer can place an Order for available Goods.
  2. Terms & Conditions - these Regulations of the online store.
  3. Seller/Author - Monika Poul artist photographer.
  4. Client - an entity with full legal capacity, who, under the terms and conditions indicated in the Regulations, places an Order in the Online Store and for whose benefit electronic services are provided.
  5. Cart - (Add to Cart) - a service provided electronically, a form that is an integral part of the shopping system in the Online Store, where the Customer approves the subject and terms of the Order (quantity, size, delivery details, method of payment).
  6. Order processing time - the time during which the Order is prepared by the Seller and then issued to the carrier. Order processing time does not include the time of delivery itself (the time between the release of the Order to the carrier and the release of the shipment to the Customer).
  7. Goods - products available in the Online Store, which are the subject of the Sales Agreement. The image of the Goods presented on the pages of the Store is a real image and is for informational purposes. 
  8. Order - the Customer's statement of intent leading to the conclusion of a Sales Agreement, with the indication of its essential terms and conditions, made using the Shopping Cart.
  9. Sales Agreement - a contract of sale of Goods within the meaning of the Act of April 23, 1964. - Civil Code, concluded in accordance with the provisions of these Regulations between the Seller and the Customer, through the Store's sales system.
  10. Additional service - a service provided by the Seller to the Customer outside the Online Store in connection with the nature of the goods sold.
  11. Payment - the method of making payment for the Contract Goods and Delivery listed at www.
  12. Delivery - the type of shipping service along with the determination of the carrier and the cost of delivery.
  13. Goods made to order - goods available in the Online Store, prepared according to the Customer's specifications, this involves a longer lead time.

 

§ 3 

Order/Purchase

  1. The online store carries out orders with shipment to Poland and other countries. For orders from abroad, the conditions and cost of delivery are discussed individually with the Customer.
  2. Before placing an order, the Customer must become familiar with these Terms and Conditions.
  3. Order by electronic means can be placed 24 hours a day, 7 days a week.
  4. The order is placed using a form available on the Store's website after adding the Goods to the shopping cart. The customer indicates: quantity, size (if possible), form of payment, address and shipping data. In case the given data are not complete, the Seller will contact the Customer. If such contact is not possible then the Seller has the right to cancel the Order.
  5. It is possible to place an individual order by e-mail through the contact form provided.
  6. By placing an Order, the Customer makes an offer to the Seller to conclude a contract for the Goods that are the subject of the Order. The conclusion of the aforementioned Contract takes place through the acceptance of the offer by the Seller, at the moment the Customer receives confirmation of acceptance of the Order for execution by the Seller. 
  7. Realization of the Order, i.e. preparation and shipment of the Goods by the Seller takes place:
    • after confirmation of the order (if payment on delivery has been selected)
    • upon receipt of payment on account (if prepayment has been selected)
    • when paying by card (from the moment of positive authorization)
  8. The term of realization of the order - standard - is 5 working days, counting from the date established (see above point). Realization of Goods on special order is arranged with the Customer individually and depends on the type of Order. 
  9. A receipt is issued for each accepted order.
  10. The store keeps the Customer informed of changes in the status of the order by sending the aforementioned information to the e-mail address provided by the Customer in the order form.

 

§ 4 

Prices and form of payment

  1. The prices given in the store are gross prices ( including taxes) and are expressed in Polish zloty (PLN).
  2. The prices given do not include delivery costs.
  3. The price binding for the Customer is the price currently quoted when placing an Order and concluding a Sales Agreement.
  4. The standard price given is the price of the work. In case of an individual order, the prices are agreed with the Customer.
  5. The Customer has a choice of the following forms of payment:
    • Transfer -payment should be made to the bank account: 00 0000 0000 0000 0000 0000 0000. It is operated by Bank ING.The transfer can be made online, at the post office or at the bank. Please include your order number in the title. Once the payment is credited to the specified account, order processing will begin.
    • Electronic payment via PayU - the most convenient and secure way to make payment via the Internet.
    • Electronic payment from PayPal account - a convenient form of payment for the order in the case of foreign payments. To make payment in this way, the customer must have his own account in PayPal.
    • In another way, if it is specified on the Store's website.
  6. The Customer is obliged to pay for the Order no later than 3 days after the conclusion of the Sales Contract.
  7. Store prices are subject to change, provided that the terms and conditions of the Order may not be changed with respect to the Customer who has made an offer in the manner indicated above, prior to the price change.

 

§ 5 

Description and photos of the artworks

  1. All photos of the Goods are review photos depicting the actual works, are an illustrative value showing the nature of the works.
  2. The way the colors are displayed is affected by the individual settings of the Client's computer and monitor. Due to this fact of possible color discrepancies, any complaints will not be considered.
  3. Each work has a description of the size and on what paper the print was made. Any additional information on the types of paper used for printing can be found at: www.monikapoul/wydruki.com.

 

§ 6 

Intellectual value

  1. It is forbidden to use any materials published on the Store's website (including photos and descriptions) without the written consent of the Store.
  2. Limited edition Fine Art prints are signed with the handwritten signature of the Author, who is the Seller, and like all works of the Seller are covered by Copyright. They are therefore an original work of art with their own Certificate of Authenticity.

 

§ 7 

Final provisions/regulations

  1. The content of the Terms and Conditions is available at all times on the Store's website. At the request of the Customer it can be sent electronically.
  2. The provisions of these Regulations are not intended to violate any rights of the Buyer. In case of inconsistency of the Regulations with the applicable law, the Seller declares the application of this law in place of the disputed provision of the Regulations.
  3. Purchasers will be informed of changes to the Regulations electronically to the e-mail address (e-mail) indicated at the conclusion of the Sales Agreement. Any changes will result from adaptation of the Terms and Conditions to the current legal status.
  4. In matters not regulated by these Regulations, the relevant applicable legal regulations shall apply. 
  5. In case of disputes related to the implementation of the concluded agreement, the parties will seek to resolve the dispute through out-of-court amicable proceedings. Including to resolve the dispute with a mediator. If the dispute is not resolved amicably, the Court of Common Pleas will have jurisdiction to resolve the dispute. 
  6. In fulfillment of the obligation to indicate the out-of-court procedures for handling complaints and pursuing claims, as well as the rules of access to these procedures, we hereby inform you that up-to-date information in this regard is made available at: http://prawaKONSUMENTA.uokik.gov.plConsumers and businesses can use the online ODR platform established by the European Commission for the amicable settlement of disputes. The platform is available at: http://ec.europa.eu/consumers/odr/. The OCCP maintains a register of entities authorized for out-of-court resolution of consumer disputes at https://www.uokik.gov.pl/rejestr_podmiot_uprawnionych.php.
